Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Random Profiles API (“Random Profiles”, “the Service”, “we”, “us”) offered at https://random-profiles.com, including the REST API at /v1/*, the website, the CLI (random-profiles on npm), and the MCP server (random-profiles-mcp on npm). By creating an API key, accessing the API, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Random Profiles generates synthetic user profiles and company records for use as seed and test data. Access is provided over HTTP via an API key. We may add, change, or remove fields, endpoints, and features over time. We will make reasonable efforts to keep documented endpoints stable, but we do not guarantee that any particular field, endpoint, or behaviour will remain unchanged.

3. Accounts and API keys

• You obtain an API key by providing a valid email address. One key is issued per email address.
• You are responsible for keeping your API key confidential. Treat it like a password. You are responsible for all activity that occurs under your key.
• If you believe your key has been compromised, contact us so we can revoke and reissue it.
• You must provide accurate information and must not impersonate another person or entity when creating an account.
• You must be at least 16 years old, or the age of digital consent in your country, to use the Service.

4. Acceptable use

You agree not to use the Service to:

• Present generated profiles or companies as real people or organisations, or use them to deceive, defraud, or impersonate.
• Create fake accounts, fake reviews, spam, or other fraudulent content on third-party platforms.
• Violate any applicable law or regulation, or infringe the rights of any third party.
• Circumvent, disable, or otherwise interfere with rate limits, usage tiers, security features, or authentication.
• Share, resell, or sublicense your API key, or attempt to evade per-account limits by creating multiple accounts.
• Attempt to gain unauthorised access to the Service, its infrastructure, or other users' data.
• Use automated means to place excessive load on the Service beyond your tier's documented limits.

We may suspend or terminate access that violates this section, with or without notice.

5. Plans, billing, and payment

The Service offers a free tier and one or more paid tiers. Current tiers, daily limits, and prices are published at https://random-profiles.com/pricing and may change from time to time.

• Payment processing. Paid subscriptions are billed through our reseller, Lemon Squeezy (Lemon Squeezy, LLC), which acts as Merchant of Record. Your payment is a transaction with Lemon Squeezy, and their terms and privacy policy also apply. We never receive or store your payment card details.
• Subscriptions. Paid plans are billed in advance on a recurring (e.g. monthly) basis and renew automatically until cancelled.
• Cancellation. You may cancel at any time from your account or the customer portal. Cancellation takes effect at the end of the current billing period; you retain paid access until then.
• Refunds. Except where required by law, payments are non-refundable. If you believe you were charged in error, contact us and we will review the request in good faith.
• Taxes. Prices may be exclusive of applicable taxes (such as VAT), which Lemon Squeezy calculates and collects where required.
• Price changes. We may change prices with reasonable advance notice. Changes apply from your next billing period.

6. Rate limits and fair use

Each tier has daily usage limits enforced per unit (each profile and each image counts toward your daily allowance). Requests that would exceed your limit are rejected with an HTTP 429 response. We may apply additional technical limits to protect the stability of the Service. Limits for each tier are documented at https://random-profiles.com/pricing.

7. Intellectual property

The Service, including its software, website, documentation, and the design of its API, is owned by us and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

Generated data

Subject to your compliance with these Terms, you may use, reproduce, modify, and distribute the synthetic profile and company data you retrieve from the Service — including in commercial products — without attribution and without further licence fees. Because the data is synthetic and machine-generated, we make no claim of copyright over individual generated records and impose no restriction on your downstream use, except the acceptable-use limits in Section 4.

8. Availability and changes

We aim to keep the Service available and reliable, but we provide it on an “as is” and “as available” basis. We do not guarantee any specific level of uptime, and the free tier carries no service-level commitment. We may modify, suspend, or discontinue any part of the Service at any time. Where reasonably practicable, we will give notice of material changes that adversely affect paid users.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated data will be suitable for any particular use. You are responsible for ensuring the data is appropriate for your use case before relying on it.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability arising out of or related to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the three (3) months preceding the event giving rise to the claim, or (b) EUR 50. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service in breach of these Terms or in violation of any law or the rights of a third party.

12. Suspension and termination

You may stop using the Service and delete your account at any time (see your account page). We may suspend or terminate your access if you breach these Terms, if required by law, or if your use poses a risk to the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including Sections 7, 9, 10, and 11) will continue to apply.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Any disputes arising out of or in connection with these Terms will be submitted to the competent court in the Netherlands, unless mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via the email address associated with your account and posted on this page with an updated “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The current version is always available at https://random-profiles.com/terms.
